This End-User License Agreement (“EULA”) is a legal agreement between you (“End User”) and Alpha Architect Performance LLC (“Developer,” “we,” “us,” or “our”) and governs your use of the MyTempo mobile application (“Licensed Application”).
This EULA is concluded between you and Alpha Architect Performance LLC only, and not with Apple Inc. Apple is not responsible for the Licensed Application or its content. This EULA may not conflict with the Apple Media Services Terms and Conditions.
You are granted a limited, non-transferable, non-exclusive license to use the Licensed Application on Apple-branded devices that you own or control, as permitted by Apple’s Usage Rules. This license does not allow use of the Licensed Application on any device that you do not own or control.
The Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing, where applicable.
Alpha Architect Performance LLC is solely responsible for providing maintenance and support services for the Licensed Application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.
To the maximum extent permitted by applicable law, the Licensed Application is provided “as is” and “as available,” without warranties of any kind. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the Licensed Application, if any. Apple has no other warranty obligation whatsoever.
You acknowledge that Alpha Architect Performance LLC, not Apple, is responsible for addressing any claims of the End User or any third party relating to the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the Licensed Application or the End User’s possession and use of the Licensed Application infringes that third party’s intellectual property rights, Alpha Architect Performance LLC will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Licensed Application, including any wireless data service agreements.
You acknowledge and agree that Apple Inc. and Apple’s subsidiaries are third-party beneficiaries of this EULA, and that Apple has the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
The Licensed Application offers auto-renewing subscriptions that provide access to premium features. Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
You can manage or cancel your subscription in your Apple ID account settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when a subscription is purchased.

The Licensed Application is not intended to diagnose, treat, cure, or prevent any disease, and does not constitute medical advice. Always consult with a qualified healthcare professional before making changes to your diet, exercise, or health regimen. Use of the Licensed Application is at your own risk.
